Wide Spread Terms of Service for Job Seekers
Terms and conditions as specified below (hereinafter called “Terms of Service”) are agreements made between Wide Spread Intertrade Recruitment Co., Ltd. (hereinafter called the “Company”) as a service provider of job searches and/or job applications for Job Seekers and searches of resumes and/or job advertisements for Employers through websites and/or applications of Wide Spread, and Job Seekers and/or Job Applicants as the users. Please read these Terms of Service thoroughly and completely before starting the use of the service.
Definitions
Under these Terms of Service, unless provided otherwise, any of the following “words” and “expressions” shall be defined as below:
“Wide Spread”
means the service of job searches and/or job applications for Job Seekers and the search of resumes and/or job advertisements for the Employers through websites and/or applications, including future products of Wide Spread Recruitment Co., Ltd. and affiliates;
“Advertising”
means the advertisements of job vacancies with the objective of personnel hiring in any job positions, including any patterns of advertising as they appear on Wide Spread;
“Data”
means data, audio files, music, pictures, videos and other similar things;
“Job Seeker”
means users of Wide Spread with an objective of job seeking which includes users who have subscribed to Wide Spread membership and users who have not subscribed to Wide Spread membership;
“Job Applicant”
means an applicant for a job position as it appears or is advertised on Wide Spread;
“Employers”
means natural persons or juristic persons lawfully registered, including limited partnerships, limited companies, public limited companies and/or juristic persons under other laws who has applied for membership with Wide Spread.
“Username”
means emails as created by Job Seekers which have been approved for logging in to and using the services of Wide Spread;
“Passwords”
means the codes created by Job Seekers which have been approved for logging in to and using the services on Wide Spread;
“Services”
means services presented on Wide Spread both with costs and without costs, including presentation of useful information to the Employers, Job Seekers and/or general public;
“Wide Spread Resumes”
means the personal profiles of Job Seekers, including educational background and work experience provided by Job Seekers which are kept in the Wide Spread system with consent from the data owners;
“Job Applications”
means applications created by Job Seekers for job positions as they appear or are advertised on Wide Spread;
1. Acceptance of Terms of Service
- These Terms of Service shall be binding on Job Seekers and/or Job Applicants who use the Services of Wide Spread upon their accepting to “Agree” of these Terms of Service.
- Job Seekers and/or Job Applicants have thoroughly read and understood these Terms of Service and agree to accept these Terms of Service before starting the use of the Services.
- All Job Seekers and/or Job Applicants must use the Services under the requirements specified in these Terms of Service, and in case there are additional Service requirements, Job Seekers and/or Job Applicants must comply with such additional requirements specified in these Terms of Service.
2. Usernames and Passwords
- Job Seekers agree to keep confidential and not disclose Usernames and Passwords or any other codes (if any) used for Wide Spread Services to third parties for any reason whatsoever. The Company shall assume no responsibilities for any damage that occurs resulting from the loss of Usernames and Passwords or any other codes (if any) or the case of third parties ascertaining such Usernames and Passwords.
- Job Seekers acknowledge that any transactions or use of Services made by using Usernames and Passwords or any other codes (if any) of Job Seekers shall be regarded as their actions which shall be binding on Job Seekers without requiring their signatures on any documents.
- For the purpose of safety, in case that Job Seekers have learned that a third party has recognized their Usernames and Passwords or any other codes (if any), the Company recommends such Job Seekers to change their Usernames, Passwords or any other codes (if any).
3. Scope of Service Provision
- For the purpose of safety or any other necessities, the Company may correct, change or add to these Terms of Service without prior notification to Job Seekers and/or Job Applicants. The Company recommends Job Seekers and/or Job Applicants to check these Terms of Service regularly during the use of Services. However, in case the Company significantly changes these Terms of Service, the Company would notify Job Seekers and/or Job Applicants via email or notify Job Seekers and/or Job Applicants by means of an announcement on the website and/or applications of Wide Spread.
- All intellectual property relating to Wide Spread, user accounts, Data, content and Services created and developed on the website and/or applications of Wide Spread or obtained during the Service provision shall be regarded as the sole rights of the Company. It is prohibited to reproduce, copy, photocopy, modify, disseminate or take any other actions for dissemination to the general public or for seeking benefits such intellectual property unless prior written consent has been received from the Company.
- The Company shall assume no responsibilities for damage, expenses or losses which may occur from the Service provision, including the delay of data transfer, the period of data dissemination, extenuating circumstances or any other events that prevent access to the use of Wide Spread Services such as connections, display errors, system stability and computer viruses, if the Company has taken reasonable care thereof or as per the circumstances.
- Job Seekers agree and consent to give Data in formats and types as requested by the Company as may be necessary and for the Service provision.
- The Company shall assume no responsibilities for the failure or defects of the whole or part of its Service provision resulting from the failure to comply with these Terms of Service.
- Job Seekers agree and accept that user accounts are available for specific use and are solely owned by account owners. Job Seekers may not transfer or allow any third parties to use their user accounts, and no third parties may subrogate user accounts from Job Seekers. Moreover, any transactions or use of any Services made by such user accounts shall be regarded as the actions of Job Seekers and shall be binding on Job Seekers only.
- The Company reserves its rights to display Advertising for Employers or third parties, including Wide Spread and/or the Company to Job Seekers through the website and applications of Wide Spread.
- The Company shall not be bound for the provision of Service until Job Seekers hand over necessary Data for Service provision to the Company.
4. Resumes of Job Seekers, Job Applications, and Other Supporting Documents for Job Applications
In case that Job Seekers and/or Job Applicants keep details and Wide Spread Resumes or Job Applications or other supporting documents for Job Applications with Wide Spread:
- The service of keeping Wide Spread Resumes or Job Applications or other supporting documents for Job Applications and the sending of the same to any Employers must be consented to in order to be passed to Employers by Job Seekers and/or Job Applicants. The Company shall be obliged to hand over Wide Spread Resumes or Job Applications or other supporting documents for Job Applications to Employers for the purpose of personnel hiring only.
- Employers may search for Wide Spread Resumes and the Company may not guarantee the minimum number of Wide Spread Resumes to be searched, contacted or handed over to Employers each day.
- Employers may pass on Wide Spread Resumes or Job Applications or other supporting documents for Job Applications of Job Seekers and/or Job Applicants to related parties.
- The Company may notify Job Seekers of incorrectness or unsuitability of Wide Spread Resumes as given by Job Seekers to Wide Spread.
- The Company shall have its absolute rights not to distribute, disseminate, pass on or cancel and remove Wide Spread Resumes or Job Applications or other supporting documents for Job Applications of Job Seekers and/or Job Applicants which were sent to the Company or recorded or kept in the system of Wide Spread, out of the system.
- The Company may refuse, remove or correct Data, Wide Spread Resumes or Job Applications or other supporting documents for Job Applications of Job Seekers and/or Job Applicants which are against the laws, good morals or having obscene or disgusting content or any other unlawful causes, as well as incorrect, erroneous, incomplete, invalid, deleted, corrected or defective Data, and the Company may correct the Data as may be deemed expedient without notification.
- Job Seekers and/or Job Applicants hereby certify and confirm that:
- Wide Spread Resumes or Job Applications or other supporting documents for Job Applications as well as details and any other Data recorded or kept in the system of Wide Spread are correct, complete, actual and up-to-date. In case there is any change of such details and Data, Job Seekers and/or Job Applicants shall be obliged to revise such details and data to be correct, complete, actual and up to date.
- Throughout the period of use of the website and/or applications of Wide Spread, Job Seekers and/or Job Applicants agree not to take any actions against laws and good morals and not to take any actions in violation of any rights of the Company or third parties or which may cause damage to the Company or third parties.
- In case it is found that Job Seekers and/or Job Applicants are in breach of the laws or these Terms of Service relating to the Data obtained from Job Seekers and/or Job Applicants, or the Data recorded or kept in the system of Wide Spread is erroneous in any way, the Company reserves its rights to remove the whole or part of the Data, delete user accounts and/or cancel the use of Services at its discretion without giving notification thereof.
- Regarding Wide Spread Resumes or Job Applications or other supporting documents for Job Applications sent by Job Seekers and/or Job Applicants to the Company or recorded or kept in the system of Wide Spread, in case there is a name, picture, contact data or personal data of a third party in them, regardless of the whole or part thereof or a copy of any document proving the existence of such third party, Job Seekers and/or Job Applicants hereby certify and confirm that they have already received consent from the owners of such personal data, and had their rights to use the Data or documents of such person as supporting documents for Job Applications or for purposes relating to Job Applications. For these purposes, the Company shall assume no responsibilities for any damage that occurs or for any litigation or demand against the use of the above-mentioned Data or documents.
- The Company shall keep Wide Spread Resumes or Job Applications or other supporting documents for Job Applications until Job Seekers and/or Job Applicants express their intention to delete the Data from the system.
5. Job Applications
- There are 4 methods of Job Applications through Wide Spread, including:
- Job Applications by giving Wide Spread Resumes: Job Seekers may submit their Job Applications through the membership subscription channel of Wide Spread and create a record to be given to Wide Spread.
- Job Applications by sending files of resumes, portfolios or other supporting documents for Job Applications: Job Seekers may submit their Job Applications through a channel for uploading files of resumes, portfolios or other supporting documents for Job Applications.
- Job Applications via emails: Job Seekers may submit their Job Applications via emails specified in the announcement of personnel hiring on Wide Spread.
- Job Applications by filling out a brief biography: Job Seekers may submit their Job Applications through a channel for inputting their brief biography in the Job Applications form, and may also attach other supporting documents for Job Applications.
- Job Seekers and/or Job Applicants have thoroughly read and understood the qualifications of Job Applicants for any positions as announced or advertised or as they appear on Wide Spread.
- Job Seekers and/or Job Applicants hereby certify and confirm that they have the qualifications and skills as announced or advertised for such job positions on Wide Spread.
- Job Seekers and/or Job Applicants acknowledge and consent to give their cooperation by coordinating with government agencies or attending any other places in person, as per the intentions of the Employers and in accordance with the nature of works as announced or advertised (if any).
- Job Seekers and/or Job Applicants agree that, in case any Data specified in Wide Spread Resumes or Job Applications or other supporting documents for Job Applications is found to be untrue or against laws or good morals or have obscene or disgusting content or have any other unlawful causes, the Company reserves its rights to refuse, cancel, remove or correct Data or Wide Spread Resumes or Job Applications or other supporting documents for Job Applications of Job Seekers and/or Job Applicants, or to suspend the service provision to Job Seekers and/or Job Applicants without notification.
- Wide Spread shall send automatic emails, such as emails for confirmation of membership subscription, emails for notification of the result of records checking, etc., for the purpose of recognition of statuses relating to user accounts or Job Applications of Job Seekers and/or Job Applicants.
- The Company shall have its absolute rights not to distribute, disseminate, pass on or cancel and remove Wide Spread Resumes or Job Applications or other supporting documents for Job Applications of Job Seekers and/or Job Applicants which have been sent to the Company or recorded or kept in the system of Wide Spread, out of the system.
- Wide Spread Resumes or Job Applications or other supporting documents for Job Applications that have been sent through the system of Wide Spread to Employers as per an announcement for personnel hiring are for the purpose of consideration of such job vacancies only.
- Job Seekers acknowledge and consent that the Company shall assume no responsibilities for any patterns of Data, content, pictures, videos or presentations as advertised or announced on Wide Spread, and that no burden has been caused to the Company for such purpose.
6. Job Applications Checking and Screening
- The Company provides services of checking resumes or other supporting documents for Job Applications given to Wide Spread to create a good image of Job Seekers and/or Job Applicants before sending such resumes or other supporting documents for Job Applications to Employers.
- The Company shall screen the content of Job Applications sent via email or submitted by sending files of resumes, portfolios, etc., and by filling in a brief biography before sending them to Employers for the prevention of spam and advertisements.
- The Company may contact Job Seekers and/or Job Applicants via emails or telephone numbers specified in Wide Spread Resumes, Job Applications, other supporting documents for Job Applications or any other contact methods to inquire about additional details for checking resumes or other supporting documents for Job Applications given to Wide Spread.
7. Searching and Recommendation of Job Vacancies
- The Company uses the search data of Job Seekers for the development of searching for job vacancies to increasingly meet the demands of Job Seekers.
- The Company uses interesting job data and jobs that Job Seekers applied for to recommend other job vacancies to Job Seekers.
- The Company shall keep the Data of Job Seekers relating to the searching and recommendation of job vacancies for a period not exceeding 1 year.
8. Obligations of Job Seekers
- In case a Job Seeker and/or Job Applicants is a minor completely under the age of 20 years old or has not reached the age of maturity by marriage, such minor must have his or her parent jointly consider these Terms of Service.
- Job Seekers must keep confidential and not disclose Passwords or any other codes (if any) for the use of Services of Wide Spread to a third party for any reason whatsoever.
- In case that Job Seekers breach the provisions contained in Sub-clause 1 or 2 above, this shall be regarded as the responsibilities of such Job Seekers, Job Applicants or parent of the aforesaid persons (as the case may be) without objection.
9. Liabilities
The Company shall assume no responsibilities for any contractual breach and/or infringement dispute in any of the following cases:
- Loss of pictures, artworks, copies, Data or Wide Spread Resumes or Job Applications or other supporting documents for Job Applications, including any patterns of documents given by Job Seekers and/or Job Applicants to Wide Spread.
- Any mistakes or errors that occur or potentially could occur from the use of Wide Spread Services or any other causes preventing the use of Wide Spread Services or the loss of Data or any damage caused by improper use by Job Seekers and/or Job Applicants or resulting from non-compliance with these Terms of Service.
- The Company, including its directors, brokers, agents or any other people involved with Wide Spread shall assume no responsibilities for any mistakes or damage resulting from employment, including any transactions made between Employers and Job Seekers and/or Job Applicants.
- The Company, including its directors, brokers, agents or any other people involved with Wide Spread, shall assume no responsibilities for any mistakes or damage that occurs from the giving of Data by Employers or resulting from the operation of Employers.
- The reliability and accuracy of announcements or Advertising as they appear on Wide Spread must be to the satisfaction of Job Seekers. The Company shall assume no responsibilities for any mistakes or damages that occur from the Data as they appear in the announcements or Advertising on Wide Spread.
- The Company shall assume no responsibilities for any damage that occurs from the breach of contracts or infringement of rights of any person resulting from the Data or Wide Spread Resumes or Job Applications or other supporting documents for Job Applications given by Job Seekers and/or Job Applicants.
10. Public Relations and Storage of Data for Marketing Purpose
- The Company shall send marketing emails, such as emails for public relations relating to Wide Spread, emails for the introduction of interesting job positions, etc., and Job Seekers and/or Job Applicants may cancel receiving such marketing emails by pressing the button “Unsubscribe” in any previous email received.
- The Company shall collect the statistical data of viewing marketing emails for content development and presentation to meet the demands of Job Seekers and/or Job Applicants.
- The Company shall use the Data from Wide Spread Resumes in marketing analysis for content presentation to meet the demands of Job Seekers.
- The Company shall collect the statistical data of use on the website and/or applications of Wide Spread for design and development of the website and/or applications of Wide Spread to increasingly meet the demands of Job Seekers.
- The Company may contact Job Seekers to ask for their recommendations on Service provision or use the recommendations to develop the Service provision of the Company.
11. Protection of Personal Data and Rights of Data Owners
- The Company strongly intends to protect the privacy and personal data of Job Seekers and/or Job Applicants. The Privacy Policy can be studied here. Click.
- Job Seekers shall have the duties and responsibilities to protect privacy or secrets, usernames and passwords (if any). In case of doubt of incursion or unauthorized access to user accounts, Usernames or Passwords, Job Seekers must immediately contact the service center at email : support@wsjob.com
- Job Seekers and/or Job Applicants may object to the storage and use of Data and may request for the deletion or destruction or treatment as unidentifiable of the Data sent by them to the Company or recorded or kept in the Wide Spread system through the service center at email : support@wsjob.com The Company shall delete or destroy or treat such Data as unidentifiable data within 90 days as from the date of receiving such a request thereof. However, regarding the Data sent out to various channels, the Company shall make its best efforts to delete or destroy or treat as unidentifiable such Data.
- Job Seekers and/or Job Applicants may revoke the consent given in respect of the collection, use or disclosure of their personal data by deleting their user accounts in the menu “configuration of user accounts” or contacting the service center at email : support@wsjob.com. provided that, with the revocation of consent given in respect of the collection, use or disclosure of their personal data, the Job Seekers are no longer able to use the user accounts on Wide Spread as a result.
- The Company hereby notifies you that after the deletion of user accounts or the revocation of consent given in respect of the collection, use or disclosure of their personal data, the Company still has to keep data of Job Seekers for another 90 days as required by law.
- In addition to the case under Sub-clause 11.5, the Company needs to keep some personal data of Job Seekers and/or Job Applicants in the system for another 10 years, even if the Company has deleted or destroyed your user accounts or data under Sub-clause 11.5, for audit and prevention of improper use of services or commission of repeated offenses resulting from behaviors relating to the use of Services of Job Seekers and/or Job Applicants which may reoccur in the system of Wide Spread.
- Job Seekers and/or Job Applicants must be solely responsible for expenses, damages, attorney’s fees, court fees or any other expenses that are incurred from arbitration, in case it appears that contract termination has resulted from the faults of such Job Seekers and/or Job Applicants.
12. Applicable Laws
These Terms of Service or other related contracts shall be subject to and governed by the laws of the Kingdom of Thailand.
